By accessing or using the Asperity Limited website, mobile application, or any of our services, you agree to be bound by these Terms & Conditions. If you disagree with any part of these terms, you may not access our services.

These terms apply to all visitors, users, and others who access our services. We reserve the right to modify these terms at any time without prior notice. Your continued use of our services after any changes constitutes acceptance of the new terms.

To place orders or access certain features, you may need to register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account
• Be at least 18 years old to create an account or place an order
• Not create multiple accounts for abusive purposes

We reserve the right to suspend or terminate accounts that violate these terms.

Order Acceptance: All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for reasons including but not limited to:

• Product unavailability or discontinuation
• Pricing errors or inaccuracies
• Suspected fraudulent or unauthorized transactions
• Shipping restrictions to certain locations

Pricing: All prices are in Kenyan Shillings (KES) and include VAT unless stated otherwise. Prices are subject to change without notice.

Payment: We accept M-Pesa, Visa/Mastercard, and Cash on Delivery (Nairobi only). Full payment is required before order processing, except for COD orders.

Order Confirmation: You will receive an order confirmation via email/SMS after successful checkout. This confirmation does not guarantee acceptance of your order.

Delivery Areas: We currently deliver within Kenya from our showroom at 6th Floor, Standard Building, Room 16, Standard Street, Nairobi. Delivery times vary by location: Nairobi (1-2 days), Kiambu (1-2 days), Other counties (3-7 days).

Delivery Charges: Shipping costs are calculated at checkout and displayed before payment. Free shipping is available on orders above KSh 5,000 for Nairobi/Kiambu and KSh 10,000 for upcountry.

Delivery Times: Estimated delivery times are provided as guidelines and are not guaranteed. We are not liable for delays caused by courier services, weather, or other circumstances beyond our control.

Risk of Loss: The risk of loss and title for products pass to you upon delivery. Please inspect your order immediately upon receipt.

Return Window: You have 7 days from the date of delivery to initiate a return. Items must be unused, unopened, and in original packaging with all accessories.

Return Address: All returns must be sent to our showroom at: 6th Floor, Standard Building, Room 16, Standard Street, Nairobi, Kenya.

Non-Returnable Items: The following items cannot be returned: earphones/earbuds, opened software/games, batteries, customized products, gift cards, and personal care items.

Return Process: Submit a return request through our Returns & Refund Policy page. Our team will review and approve within 24-48 hours. Once approved, we will arrange pickup for returns within Nairobi.

Refunds: Refunds are processed within 5-7 business days after inspection. M-Pesa refunds are instant, while bank transfers may take 3-5 days. Original shipping costs are non-refundable.

Restocking Fee: A 10% restocking fee may apply to returns not due to our error.

Warranty Coverage: All products come with manufacturer warranty. Warranty periods vary by product: Smartphones (12 months), Laptops (12-24 months), TVs (24 months), Audio products (6-12 months), Accessories (6 months).

What's Covered: Manufacturing defects, hardware malfunctions, battery issues, charging problems, and display defects under normal use.

What's Not Covered: Physical damage (cracks, drops), water/liquid damage, unauthorized repairs, accessories, software issues, normal wear and tear, and damage from misuse.

Warranty Claims: Submit a warranty claim through our Warranty page. You may need to provide proof of purchase and photos/videos of the issue.

All content on our website, including text, graphics, logos, images, product designs, and software, is the property of Asperity Limited or our licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, or reproduce any content without written permission
• Use our trademarks or branding without authorization
• Reverse engineer any part of our website or services
• Frame or mirror any part of our website

Violation of these terms may result in legal action.

When using our services, you agree not to:

• Violate any applicable laws or regulations
• Use our website for fraudulent purposes or to impersonate others
• Attempt to gain unauthorized access to our systems or user accounts
• Interfere with the proper working of our website or services
• Upload malicious code, viruses, or harmful content
• Scrape, crawl, or extract data from our website without permission
• Harass, abuse, or threaten other users or our staff
• Make false or misleading statements about our products or services

We reserve the right to terminate accounts and block users who engage in prohibited conduct.

To the maximum extent permitted by law, Asperity Limited shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Damages arising from delay or failure to perform due to causes beyond our reasonable control
• Inaccuracies or errors in product descriptions or pricing

Our total liability for any claim arising from your use of our services shall not exceed the amount you paid for the product giving rise to the claim.

Some jurisdictions do not allow limitations on liability, so this provision may not apply to you.

These Terms & Conditions shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
